Platform Terms of Use (2024)

Introduction
All content on this platform ("WOMANSHIP") is owned and operated by WOMANSHIP a company with its principal place of business at Palamedesstraat 7-1, 1054 HS Amsterdam, The Netherlands, with a company registration number 51307596 (hereinafter referred to as “WOMANSHIP”) and/or its clients and/or other right holders and is made available to you for informational purposes only. 

By accessing or using this Platform, you agree to these Terms of Use. If you wish not to agree to these Terms of Use, you should not use this Platform.

PRACTICE   The private portal from which a PROFESSIONAL operates their practice on WOMANSHIP   including their PROFESSIONAL Profile

MEMBER   An anonymous MEMBER of the WOMANSHIP community

COMMUNITY   Aggregated MEMBERs of the WOMANSHIP community

DIRECTORY   WOMANSHIP Wellness Directory of PROFESSIONALS

CLIENT    A MEMBER who contracts specific services or products from a PROFESSIONAL

EMPATHY CIRCLE  A group of five MEMBERs and one PROFESSIONAL 

The WOMANSHIP Platform
The WOMANSHIP online platform is available at https://community.womanship.co.

WOMANSHIP is a MEMBER only Community Platform for women. It provides access to content, events, services and products delivered by Wellness Professionals (PROFESSIONALs) and a safe space for women to fully open-up and ask questions about their problems, and worries. This is facilitated by enabling MEMBERs to interact anonymously on Community Forums that cover a range of health and wellbeing subjects. 

Our Platform also provides a place for people who are registered as PROFESSIONALs to showcase their services, deliver business services and connect with the WOMANSHIP community (“Community”).

Content

We have compiled the content of WOMANSHIP with the greatest possible care. However, the WOMANSHIP is only offered for informative purposes. WOMANSHIP does not guarantee that the content of the Platform is accurate, up to date and complete, or that the Platform will be uninterrupted and/or free of errors. Reliance on any information provided by WOMANSHIPthers appearing on the WOMANSHIP webPlatform or platform is solely at your own risk.

References on WOMANSHIP to products or services do not constitute an offer for the sale or supply of that product or service.

To the extent permitted by law, WOMANSHIP, including its affiliates, officers and employees, hereby excludes all liability for any damages of any kind, direct and/or indirect, arising out of and/or as a result of your use of the Platform or any other Platform linked to the Platform. 

Services, features or functionality of WOMANSHIP

WOMANSHIP may update and change the Platform from time to time, including by making available to MEMBERs or discontinuing certain services, features or functionality. These Terms of Use will apply to such new services, features or functionality, unless they come with separate or additional terms, in which case MEMBERs will be required to agree to such separate or additional terms before being permitted to use the new services, features or functionality.

WOMANSHIP may suspend or withdraw or restrict the availability of all or any part of the Platform for business and operational reasons. WOMANSHIP will try to give MEMBERs reasonable notice of any suspension or withdrawal.

MEMBERs acknowledge that the availability and use of certain services, features or functionality on the Platform may vary between MEMBERs depending on, for example, location and account type (paid or free).

PROFESSIONAL Services

When a MEMBER retains the services of a WOMANSHIP PROFESSIONAL they become a CLIENT of that PROFESSIONAL and the respective service agreement is concluded between the MEMBER and PROFESSIONAL Service Provider. WOMANSHIP will help matching PROFESSIONAL Service Providers with MEMBERs requesting services. However, WOMANSHIP is not a contractual partner to the PROFESSIONAL service agreement. Accordingly WOMANSHIP does not assume responsibility for the services provided by the PROFESSIONAL service provider.

WOMANSHIP does not recommend or endorse any specific PROFESSIONALs, tests, products, procedures, medical treatments, mental health treatments,  therapy approaches, individual therapists or mental health providers. 

Links to Other Platforms
This Platform may provide access to other Internet webPlatforms. WOMANSHIP does not control these Platforms, and you access them solely at your own risk. WOMANSHIP also does not endorse or approve any products or information offered at Platforms you reach through this Platform. Check the Uniform Resource Locator (URL) address provided in your Internet browser to determine if you are still in this WOMANSHIP Platform or have moved to another web Platform.

Account

In order to access some features of the WOMANSHIP Platform, a person will have to register and become a Community MEMBER or a PROFESSIONAL and these terms shall apply for the MEMBER. MEMBERs and PROFESSIONALs shall only provide information about itself, including (if applicable) their organisation, and shall ensure all account information is up to date at all times in order to create opportunities based on current information.

MEMBERs will provide information that is accurate, and not false or misleading. This applies to all MEMBER profile information, posts and comments. WOMANSHIP reserves the right to block any MEMBER of the platform that breaches this requirement.

WOMANSHIP has the right to suspend any MEMBER  or PROFESSIONAL account, at any time, if in its reasonable assumption the MEMBER appears not to comply with provisions of these Terms of Use.

MEMBER and PROFESSIONAL are solely responsible for their account and any activity on it, and must keep their username and password secure. As soon as a MEMBER becomes aware of any unauthorised use of its account or password, the MEMBER must notify WOMANSHIP immediately by contacting: support@WOMANSHIP.co 

c o. WOMANSHIP will not be liable for any losses caused by any unauthorised use of the MEMBER’s account.

MEMBERs who are individuals must be either 18 years of age or over, or have the consent of their parent or guardian to use the Platform.

Community MEMBER Anonymity

Unless a Community MEMBER decides to share their personal information, their interactions on the Platform will be anonymous, using a user name and avatar of their choice.

WOMANSHIP are not responsible for the loss of anonymity for Community MEMBERs who share their personal information with other Community MEMBERs.

To engage in PROFESSIONAL Service provision, Community MEMBERs may be required to share their personal details with the PROFESSIONAL. The information can only be accessed by that PROFESSIONAL and it is the responsibility of the PROFESSIONAL to maintain MEMBER and CLIENT confidentiality and their industry code of ethics.

Personal Data

If you provide us with personal information through the Platform, such as your name and e-mail address, name, age, social media accounts our Data Protection Policy applies. Any information WOMANSHIP decided to share with third parties will only ever be on an aggregated basis (cannot be linked back to an individual MEMBER or CLIENT). We advise you to read this Data Protection Policy carefully before you provide us with this information.

Information and Material Provided by You

If you provide WOMANSHIP with information or other material, you agree that we may use it. You guarantee that the information or material does not violate intellectual property rights or other rights of third parties or is otherwise unlawful.

On certain parts of the Platform MEMBERS can place information themselves. It is impossible for us to check this information in advance and  therefore do not assume responsibility for this. We reserve the right to shorten, modify or remove this information at any time.

Use of material and content on the Platform

WOMANSHIP is the owner or the licensee of all intellectual property rights in the Platform, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Unless otherwise specified, the Platform is provided for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software or products obtained from the Platform. Any other use of materials on the Platform, including but not limited to the modification, reproduction, distribution, republication, display or transmission of the content of this Platform, without the prior written permission of WOMANSHIP is prohibited.

Uploading content to the Platform

Whenever a PROFESSIONAL or MEMBER make use of a feature that allows it to upload, link or otherwise transmit (“contribute”) content (including film, video, audio and image material, text, data and information) to the Platform (“MEMBER Content”), or to communicate with other MEMBERs of the Platform, the MEMBER must comply with the content standards set out as follows:

MEMBER content is prohibited if it:

• promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
   
• is intended to or tends to harass, annoy, threaten or intimidate any other users of the Platform or Services;
   
• is defamatory, inaccurate, abusive, obscene, profane, offensive, sexually explicit, obscene or otherwise objectionable;
   
• contains others’ copyrighted content (e.g., articles, videos, photographs, images, etc.) without obtaining permission first;
   
• contains video, audio photographs, or images of another person without his or her permission (or in the case of a minor, the minor’s legal guardian);
   
• promotes or enables illegal or unlawful activities, such as instructions on how to make or buy illegal weapons or drugs, violate someone’s privacy, harm or harass another person, obtain others’ identity information, create or disseminate computer viruses, or circumvent copy-protect devices;
   
• intended to defraud, swindle or deceive other users of the Services;
   
• contains viruses, time bombs, trojan horses, cancelbots, worms or other harmful, or disruptive codes, components or devices;
   
• promotes or solicits involvement in or support of a political platform, religion, cult, or sect;
   
• disseminates or otherwise discloses another person’s personal information without his or her prior permission, or collects or solicits another person’s personal information for commercial or unlawful purposes;
   
• is off-topic, meaningless, or otherwise intended to annoy or interfere with others’ enjoyment of the Platform;
   
• impersonates, or otherwise misrepresents affiliation, connection or association with, any person or entity;
   
• uses scripts, bots or other automated technology to access the Platform or Services;
   
• uses the Platform or Services for chain letter, junk mail or spam e-mails; or
   
• is in any way used for or in connection with spamming, phishing, trolling, or similar activities.

MEMBER content that violates these restrictions will be removed by WOMANSHIP. In addition, WOMANSHIP reserves the right to suspend, or even terminate the MEMBER account in case of repeated breaches of content restrictions.

WOMANSHIP has the right to remove any MEMBER Content that has been contributed to the Platform if, in WOMANSHIP’s opinion, the MEMBER  Content does not comply with these Terms of Use, the Platform or Privacy Policy. WOMANSHIP nonetheless assumes no obligation to modify or remove any MEMBER Content.
